For the purposes of authentication, using your username and password is considered the same as using your signature, and you will be held to the same standard. It is the end users sole responsibility to review all educational material and tutorials at as well as in project specific instructions. Terms of use of this site are governed by the within agreement and any other further service agreement or the like, executed by and between the End User and Projectdog, Inc. Please read these terms and conditions of use carefully before using this site. By using this site, you signify your assent to these terms of use. If you do not agree to these terms of use, please do not use the site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time without notice. LICENSING RESTRICTIONS

For the purposes of authentication, using your Password is considered the same as using your signature. The End User shall not share his/her unique username and password (user ID) for access to our portals. In the event your User ID is shared all access will be denied without notice. If documents are needed, the End User can contact Projectdog, Inc to obtain physical (paper, CD, USB, or other physical media) documentation. Specific project data will be stored and accessible for no less than 30 days post bid. The End User shall not sell, assign, and transfer any license granted hereunder. All business transacted on this website shall be considered to have been transacted within the Commonwealth of Massachusetts, the principal place of business of Projectdog, Inc.

DOCUMENTS AND DATA ON THIS WEB SITE

Permission to use data and access this server ('Server') is granted, provided that (1) the aforementioned Terms and Conditions to our portals appears in all copies, (2) use of such data from this Server is for informational and non-commercial or personal use only and will not be copied or posted on any network computer or broadcast in any media, and, (3) your Content in our services: When you upload or otherwise submit to our services and servers, you give Projectdog, Inc ownership rights of all data and a worldwide license to save, retain, use, host, store, reproduce, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content. FILE SUBMISSION AND UPLOAD TIMES

The end user must allow sufficient time for submissions and file uploading, all project actions must be completed prior to project deadlines, if the end user miscalculates submission time requirements the submission will be rejected (not allowed) by the server in accordance with the project specific time/date submission deadline. Items affecting upload time requirements are but not limited to: file size, bandwidth, ISP provider, third party server configuration, hops, distance, weather, time of day and many other unforeseen circumstances, it is the users sole responsibility to provide sufficient time when uploading and submitting all and any data by the time set forth in the project documents, allow 1 minute/1 Megabyte to upload files as a minimum standard.

COLLABORATIVE PROCESSES & E-BID

Paper copy submissions will not be accepted when an electronic procurement is being performed. Electronic Procurements are allowed and governed by MGL 30b section 2, 6, 7 and MGL 110G, along with U.S. Code 15 § 7001. Accepted electronic signature methods are:

A digital signature cannot be held to a higher standard than paper (handwritten) signatures. All digital signatures are the legal equivalent of having places a handwritten signature on the bid proposal and its constituent documents certifying the accuracy of all information contained in the submitted proposal and agree to be bound by it. All documents will be deemed digitally signed and certified by the authorized logged-in individual on behalf of the bidding entity. A signature check on electronic or paper-based submission is the responsibility of the awarding authority as deemed necessary by the awarding authority. Please maintain security certificates associated with digital signatures in case of an inspection of validity and all original documents from your vendors as needed and required. The end user must allow sufficient submission time in accordance with the project specific time/date submission deadline.

VIOLATIONS

Violations of the above terms may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. If you are competitor of Projectdog.com and access private documents you will be charged no less than ten times the access fee for each project acquired in addition to additional legal action. The End User agrees that violations of the terms of this Agreement will cause Projectdog, Inc substantial harm entitling it to injunctive relief.
